Hennis Enterprises Limited Warranty

Hennis Enterprises hereby warrants its parts upon the following conditions against defects in materials and workmanship for a period of ten years after delivery to Purchaser when used and installed under normal conditions. THE FOREGOING WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES NOT EXPRESSLY SET FORTH HEREIN. WHETHER EXPRESSED OR IMPLIED BY OPERATION OF LAW OR OTHERWISE, INCLUDINGBUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR MERCHANTABILITY OR FITNESS. Failure to follow Hennis Enterprise’s Storage and Installation Instructions will void this limited warranty. Buyer and installer must inspect each piece prior to installation. Buyer and installer waive all claims to defects, which could have been discovered by reasonable inspection prior to installation. This includes misalignment, misfit parts, dimensional discrepancies and the like. In the event that any claim is made under this warranty, an authorized representative of Hennis Enterprises has the right to inspect the parts and if, in his or her sole discretion, said representative determines the parts to be defective, Hennis Enterprises will repair, replace or refund to it’s distributor the amount paid to Hennis Enterprises for said defective parts. Hennis Enterprises may choose to repair or if need be replace the defective parts provided they are returned freight prepaid to Hennis Enterprises (3052 N. Ventura Ave. Ventura, CA 93001). The sole obligation of Hennis Enterprises under this warranty is to REPAIR, REPLACE OR REFUND as described above. HENNIS ENTERPRISES SHALL HAVE NO LIABILITY TO ANY PERSON, FIRM OR CORPORATION WHATSOEVER FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES such as but not limited to labor, finishing cost, parts damaged by freight carriers, freight charges, installation, lost profits, lost sales or the like. NO PURCHASER MAY TAKE ANY DEDUCTION, CREDIT OR SETOFF AGAINST ANY AMOUNT OWED HENNIS ENTERPRISES OR MAKE A CHARGEBACK WITHOUT EXPRESS WRITTEN CONSENT OF HENNIS ENTERPRISES.
